Aviation Accidents and Wrongful Death
An aviation accident, by its very nature, is often fatal. It can also involve multiple responsible parties, more than one federal agency, interstate litigation and much more. Aviation law and aviation accidents are very specific areas of law with overlapping jurisdictions.
At Mattox & Wilson, L.L.P., attorney Richard Mattox is a Land and Sea Instrument Single Engine and Multi-engine Rated pilot. He was an Air Force Captain and is a commercial pilot. He is also a skilled trial lawyer with experience in complex litigation. His combination of experience and background is an asset for our aviation litigation clients.
Although our law office is located in New Albany, Indiana, we represent clients throughout Indiana.
Defense or Plaintiff Representation
Our law firm's experience with aviation law includes representation of either the plaintiff or the defendant. We have significant experience working with both the National Transportation Safety Board (NTSB) and the Federal Aviation Administration (FAA) in accident site investigations. It has been our observation that about 80% of the time the FAA and NTSB will determine that an aviation accident is due to pilot error. In most instances our task is to prove otherwise.
A few of our cases include the following:
- Representation of a pilot for a helicopter accident related to rotor separation caused by helicopter overload at a construction site
- Representation of a fixed wing pilot accused of pilot error for an accident caused by propeller failure
- Representation of an aircraft manufacturer in wrongful death litigation related to faulty equipment
